These General Terms and Conditions of Sale are intended to define the rules applicable to the sale of Products marketed on the Site (hereinafter "the Site"),

These terms apply to all orders placed on the Site.

These general terms and conditions (hereinafter the "General Terms and Conditions of Sale") govern without restriction the sales of Products made by Le Petit Florilège from the Site.

Le Petit Florilège reserves the right to modify these General Terms and Conditions of Sale at any time without notifying its Customers, by publishing a new version on the Site.

The General Terms and Conditions of Sale described below detail the rights and obligations of Le Petit Florilège and the Customer in the context of the sale of goods on the Site.

The applicable General Terms and Conditions of Sale are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and unreserved acceptance of the General Terms and Conditions of Sale.

These General Terms and Conditions of Sale comply with articles L 111.1 and L 113.3 of the Consumer Code, informing the Customer about prices, descriptions, limitations of contractual liability, and details of the sale.

Article 3 - Presentation of the Products

The characteristics of the Products offered for sale are presented in the Product sheets on the Site by means of photograph(s), image(s), descriptive text, conditions of use, any specific characteristics, and prices including all taxes. Le Petit Florilège cannot be held liable if errors have been introduced therein. Due to the diversity of hardware that may be used by the Customer to display the Site and any variations in colorimetric and qualitative reproduction of the Product photographs on said hardware, the photographs do not fall within the contractual scope.

The Products are presented in a staged context allowing them to be highlighted, and the photographs represent a suggestion of presentation. Only the description on the product sheet and the selection menu (if it exists) have the value of a description and designation of the product or its variant validated by the customer. All texts, images, videos, and audio clips presented on the Site are reserved, worldwide, under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.

Article 4 - Validity period of sales offers

The Products are offered for sale until stocks run out. In the event of an order for a Product that has become unavailable, the Customer will be informed of this unavailability as soon as possible by email or postal mail.

Article 5 - Price

Each Product sheet on our site indicates the price of each Product in euros, freely set by Le Petit Florilège, expressed including all taxes, excluding shipping costs. The amount of VAT is specified when the Customer views the shopping cart, and the related shipping costs (covering packaging and carriage costs) are also indicated in the cart.

Le Petit Florilège reserves the right to modify its prices at any time, but the Products ordered are invoiced at the price in effect at the time the order is registered.

All prices are non-negotiable by the Customer.

No discount will be granted to the Customer in the event of early payment.

Article 6 - Cart

The Cart page summarizes all the Products selected by the Customer and indicates the shipping costs (including packaging and carriage costs) inherent to their order. The page provides the Customer with a "Recalculate" button which allows for the updating of sub-totals, totals, and shipping costs in the event of a change in quantities or the deletion of a Product.

The collection of personal information is essential for invoicing, processing, and shipping orders.

In order to preserve the confidentiality of your personal data, any request concerning the implementation of your rights must include, for the attention of our DPO, a certified true copy of a valid identity document (identity card or passport). After validating the Cart, the Customer must validate the acceptance of these General Terms and Conditions of Sale, identify themselves if they already have a personal account on the Site, or create one if they wish.

After validating the shopping cart, the Customer indicates their billing and delivery details, also indicating if these details are different or identical.


Article 8 - Order


The Customer validates their order when they activate the "Pay for order" link at the bottom of the "Summary" page. Before this validation, the Customer is systematically offered the opportunity to verify each element of their order; they can thus correct any errors and have the ability at any time to identify and correct any errors made during the entry of their data.

They must verify all information provided in this order form, and in particular all elements useful for delivery (delivery address, door code, telephone numbers, etc.) of their order. The address supplement must not exceed 32 characters at the risk of being truncated. Le Petit Florilège cannot be held responsible in the event that delivery cannot be made due to exceeding the maximum number of characters for the address supplement.

Orders cannot be canceled or modified once validated and paid for.

In accordance with legislation, it is impossible to modify the billing address after payment and the subsequent automatic issuance of the invoice.

The order placed by the Customer is only effective upon conclusion of the full payment of the sums due.

If, due to a case of force majeure (strike, natural disaster, business closure, death, illness, accident, war, etc.), Le Petit Florilège is unable to fulfill an order for products made to measure or according to the Customer's specific specifications, a full refund of the sums previously paid for this order will be made, and the Customer may not initiate any legal action to compensate for any damages caused.

Article 9 - Payment methods

Orders are paid for by credit card only.

In the case of an order from a zone other than the one defined by these General Terms and Conditions of Sale, a payment method by bank transfer may be proposed to the Customer by Le Petit Florilège.

When registering the order, the Customer must pay the full amount of their order via the payment methods offered by the Site at the time of the order.

The Site offers the customer online payment with its banking partner Crédit Agricole via the secure e-Transactions payment block and via the Paybox system.

This system is only compatible with bank cards certified 3D Secure, Verified by Visa, or SecureCode Mastercard.

If the Customer pays with a bank card registered for 3D Secure, Verified by Visa, or SecureCode Mastercard, they will be invited to identify themselves with a personal code guaranteeing their identity to finalize the online payment.

In case of authentication failure, their order will not be taken into account.

In order to prevent any credit card fraud, Le Petit Florilège reserves the right to refuse any sale for which the payment does not offer all 3D Secure security validations or presents suspicions of fraud.

After payment on the secure server offered on the Site, an acknowledgement of receipt is displayed. It confirms the registration of the order and informs the Customer that a confirmation email including all the elements of the order will be sent to them as soon as possible.

The data recorded by Le Petit Florilège constitutes proof of the nature, content, and date of the order. This is archived by Le Petit Florilège under legal conditions and deadlines; the Customer can access this archive by contacting the Customer Relations department.

Article 10 - Late payment

In the event of a total failure to pay for the goods delivered on the day of receipt, the Customer must pay Le Petit Florilège a late payment penalty equal to one and a half times the legal interest rate.

The legal interest rate retained is the one in force on the day of delivery of the goods.

This penalty is calculated on the amount excluding taxes of the sum remaining due, and runs from the due date of the price without any prior formal notice being necessary.

In accordance with articles 441-6 of the Commercial Code and D. 441-5 of the Commercial Code, any late payment automatically entails, in addition to late penalties, an obligation for the debtor to pay a fixed indemnity of €40 for collection costs.

An additional indemnity may be claimed, upon justification, when the collection costs incurred are higher than the amount of the fixed indemnity.

Article 11 - Delivery

Delivery of Products will be carried out at home by the services of La Poste, DPD, GLS, Geodis, or any other carrier of the seller's choice, depending on the typology and volume of the order, and the most appropriate for deliveries in metropolitan France and the European common market, continental zone only.

For delivery to another zone offered on the Delivery page, transport and delivery will be carried out by a La Poste partner or one of the carriers chosen by the seller in the country concerned, and the delivery time may be extended. For delivery to a zone not listed on the Delivery page, a written request by email must be made via the contact form provided to the Customer. Le Petit Florilège reserves the right to accept or refuse delivery to another zone.

Delivery methods vary according to the type and weight of the package, or at the seller's discretion.

Once shipped to their home, in the event that the customer chooses to redirect their delivery to a pickup point via the carrier's platform, they are informed that the chosen pickup point is liable to refuse to handle the package (notably in case of saturation of its capacity to handle the package, change of opening hours, exceptional closure, etc.), in which case the package will be directed to a new pickup point or a Post Office located on the carrier's route. The company Le Petit Florilège cannot be held responsible for this change of delivery location, and the customer cannot request compensation for any inconvenience caused by a change of pickup point compared to the one chosen after shipment to their home.

It is the customer's responsibility to refuse any package showing signs of damage or whose packaging has been damaged during transport, and this from the moment of delivery by the delivery services. In case of acceptance of a damaged package by the customer, this equates to acceptance of the goods in their current state, and Le Petit Florilège cannot be held responsible for damages caused to the goods by our carrier.

A package tracking number will be sent by email to the Customer for Colissimo items upon shipment of their order.

Delivery times are generally set, for an address in metropolitan France, at the day of payment validation + 8. This period may be extended in the event of public holidays during this period or shop closure during holiday periods (an announcement visible on the homepage will inform the customer of new order processing terms and extended delivery times).

Delivery times for Products made to order or according to the Customer's specific specifications are set at a maximum duration of 30 days.

In the case of an order combining new products and custom or made-to-order products, shipment may be carried out in several packages, with deadlines specific to each type of product.

Le Petit Florilège may inform the customer directly by email as soon as delivery time details are available.

In the event of the Customer providing incomplete or inaccurate delivery information, Le Petit Florilège cannot be held responsible in case of delay or impossibility of delivery. In the event of return of goods for these reasons, the re-shipment costs will remain the responsibility of the customer.

In the case of delivery by Colissimo requiring a signature, if the Customer is not present when the courier passes, a notice will be left in their mailbox or sent by SMS or email, and they will have a period consultable on the carrier's website to collect it from their Post Office or a merchant partner of the carrier. At the end of this period, the package will be returned to Le Petit Florilège and the Customer must bear the costs of a new shipment.

The Customer is informed that it is their responsibility to check, in the presence of the courier, the condition of the package upon receipt and to immediately issue reservations in case of damage, anomaly, or late delivery to the courier by mentioning it on the delivery note. In the absence of reservations, the Customer will not be able to turn against Le Petit Florilège. Deliveries by carrier are carried out at the foot of the customer's home on public property.

If transport damage occurs, we encourage you to contact us within 3 days (Article L.133-3 of the Commercial Code) and to provide us with photographs of the damaged package, the damaged product, and the shipping label on the box. After this period, no claim will be admissible, and the products will be considered as having been delivered in good condition.

Article 12 - Right of Withdrawal

In accordance with applicable legislation, the Customer has a period of 14 (fourteen) business days from the date of receipt of their goods to withdraw, and a period of 14 (fourteen) days from their withdrawal notice to return their package, without justification or penalty.

Personalized products, made-to-measure or custom-made products, unsealed products (particularly those related to hygiene), and fragile products are not covered by the right of withdrawal.

The right of withdrawal between professionals may apply only when the following three conditions are met:
- the contract is concluded off-premises
- the subject of the contract does not fall within the company's main activity
- the client company does not employ more than five employees

Otherwise, the right of withdrawal does not apply.

For any return within the scope of this right of withdrawal, the following procedure must be fully respected:

- The Customer shall contact Le Petit Florilège via the contact form provided, indicating their wish to return their product and specifying the order number provided on their order acknowledgment. For the purpose of improving our services, the Customer may indicate the reason for the return.

- Le Petit Florilège, upon validation of the return, will provide the Customer with the return procedure.

- The returned product must be packaged in suitable packaging, ensuring the integrity of the product during the return shipment. - Returns via Mondial Relay, relay points, lockers, or post offices are not accepted and will not be collected. Packages must be shipped directly to the provided return address.

- Unless otherwise indicated, return costs are the sole responsibility of the Customer.

- Cash-on-delivery returns are not accepted.

Subject to the aforementioned conditions, Le Petit Florilège will refund the total amount including tax of the order corresponding to the returned products, excluding initial shipping costs if the return is partial. The Customer's bank account will be credited with said amount within 14 (fourteen) days from the receipt of the Products by Le Petit Florilège.

In the event of damage, loss, or destruction of the package during a return, the entire order and return costs will remain the responsibility of the Customer.

Article 13 - Legal Conformity Guarantee

Le Petit Florilège undertakes to deliver Products that meet the applicable health and safety requirements in accordance with French provisions, and in particular the legislation on regulated chemical substances.

The Site offers products resulting from artisanal manufacturing (textile items, ceramics, etc.), which may lead to variations in shades, shapes, finishes, and fading, which cannot be considered defects.

As the Site also offers used or "vintage" items from second-hand trade, which may not comply with the standards in force at the time of purchase, the Customer declares to be informed and accepts them in their current state.

Article 14 - Customer Relations - After-Sales Service

For any information, question, or complaint, the Customer can contact the Customer Relations department of Le Petit Florilège from Monday to Friday, from 10 a.m. to 5 p.m., by email at serviceclient (@) lepetitflorilege.com, via the contact form on the Site, or by mail to Le Petit Florilège - Lieu-dit Lamaresque - 46500 PADIRAC

Article 15 - Satisfaction Guaranteed or Refunded

In accordance with legal provisions, the Customer has 14 clear days from delivery to return their order, with return costs being at their expense. They are then refunded the full amount paid in the event of a total return of their order within 30 days following its receipt in good condition by Le Petit Florilège. In the case of a partial return, only the amount of the returned product will be refunded. At the proposal of Le Petit Florilège, the Customer may also opt for another refund method.

Products returned used, incomplete, damaged, or soiled are not accepted and cannot be refunded; initial shipping and return costs remain the responsibility of the Customer.

It is also the customer's responsibility to keep the original product packaging in good usable condition to return the products. Otherwise, Le Petit Florilège reserves the right to partially refund returned products that are not in a condition suitable for resale.

Custom-made and personalized products are not covered by these return terms and cannot be refunded.

In accordance with legal provisions, the right of withdrawal cannot be exercised for Products made to order, used "vintage" or second-hand products, or products made according to the Customer's specific requirements.

Article 16 - Referral Program

The referral program offered by SARL Le Petit Florilège is intended to allow our existing customers (referrers) to recommend our company to third parties (referees) who have never placed an order with us. Each referrer and referee who meets the conditions of this program may benefit from the advantages specified in the current referral offer.

Any attempt at abusive use of the program, including but not limited to self-referral, the use of multiple accounts belonging to the same person or members of the same household, or any other form of fraud, is strictly prohibited. Referees must be distinct individuals and reside at a different address from that of the referrer.

We reserve the right to refuse or cancel any reward resulting from non-compliant use, as well as to suspend or close the concerned accounts.

This program is a tool intended exclusively for the acquisition of new customers. Any participation implies the acceptance of these conditions as well as the rules of proper use defined by SARL Le Petit Florilège. We reserve the right to modify or suspend the program at any time, without notice.

Article 17 – Disputes

The Site and all Le Petit Florilège sites, whose main domain name is lepetitflorilege.com (blog.lepetitflorilege.com, etc.), are governed by French law.

In the event of a dispute, the Customer undertakes to seek an amicable solution before any action in court. In the event of failure to reach an amicable solution, any action may be brought only before the French courts.

Article 18 - Professional Discounts

We offer a 10% discount starting from a minimum of €350 incl. tax per order for professionals in the space design industry.

This discount is applied only to eligible products, the list of which is left to the discretion of Le Petit Florilège. Products deemed bulky are systematically excluded from this professional discount.

In accordance with legislation, the right of withdrawal does not apply to sales between professionals (see conditions in Article 12).

To benefit from the professional discount, the professional must prove their activity by sending their "Kbis" business registration document for space design professionals.

A discount code to be used by the professional themselves and not by their customers will be assigned and linked to their account. This code and the account may not be transferred to the client.

Unless otherwise stated, the professional discount cannot be combined with Sales, private sales, or temporary promotions. If, for technical reasons, an order placed using the professional code contains products at discounted or sale prices in addition to the professional discount, SARL Le Petit Florilège reserves the right to cancel the order and propose a new order at the sole discount conditions of their choice: either the current promotion price or the professional rate.
