Article 1 - Purpose
These General Terms and Conditions of Sale are intended to define the rules applicable to the sale of Products marketed on the Site (hereinafter "the Site").

These conditions apply to all orders placed on the Site.
These general terms and conditions (hereinafter the "General Terms and Conditions of Sale") govern without restriction the sales of Products made by Le Petit Florilège from the Site.
Le Petit Florilège reserves the right to modify these General Terms and Conditions of Sale at any time without notifying its Customers, by publishing a new version on the Site.
The General Terms and Conditions of Sale described below detail the rights and obligations of Le Petit Florilège and the Customer in the context of the sale of goods on the Site.
The applicable General Terms and Conditions of Sale are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Terms and Conditions of Sale.
These General Terms and Conditions of Sale comply with articles l 111.1 and l 113.3 of the Consumer Code informing the Customer about prices, descriptions, contractual limitations of liability and details of the sale.

Article 3 - Product Presentation
The characteristics of the Products offered for sale are presented in the Product pages of the Website through photographs, images, descriptive text, conditions of use, any special features, and prices including VAT. Le Petit Florilège cannot be held liable for any errors that may have been introduced. Due to the diversity of equipment that may be used by the Customer to display the Website and the potential variations in color reproduction and quality of Product photographs on said equipment, the photographs are not contractually binding.
The Products are presented in a staged setting to showcase their best features, and the photographs are for illustrative purposes only. Only the description on the product page and the selection menu (if any) constitute a description and designation of the product or its variant as selected by the customer. All texts, images, videos, and audio clips displayed on the Site are protected worldwide by copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.
Article 4 - Validity period of sales offers
Products are offered for sale while stocks last. If an ordered product becomes unavailable, the customer will be informed of this unavailability as soon as possible by email or postal mail.
Article 5 - Price
Each product page on our website displays the price of each product in euros, freely set by Le Petit Florilège, inclusive of all taxes but excluding shipping costs. The VAT amount is specified when the customer views their shopping cart, and the applicable shipping costs (covering packaging and handling) are also indicated in the cart.
Le Petit Florilège reserves the right to change its prices at any time, but the Products ordered are billed at the price in effect at the time the order is registered.
All prices are non-negotiable by the Client.
No discount will be given to the Customer in case of early payment.
Article 6 - Basket
The Shopping Cart page summarizes all the Products selected by the Customer and displays the shipping costs (including packaging and handling) associated with their order. The page provides the Customer with a "Recalculate" button, which allows them to update subtotals, totals, and shipping costs if quantities are changed or a Product is removed.

Purposes of the processing
The collection of personal information is essential for billing, processing and shipping orders.
The personal data collected is used for customer management and customer support, connection to private areas, sending emails in response to contact forms, sending promotional offers by email and sending newsletters by email (offered only by Le Petit Florilège).
Some data is collected automatically as a result of your actions on the site in order to carry out audience measurements (number of page views, number of site visits, products viewed, etc.) or is necessary for the prevention and resolution of technical incidents.

To protect the confidentiality of your personal data, any request concerning the exercise of your rights must include, addressed to our Data Protection Officer (DPO), a certified copy of a valid identity document (identity card or passport). This copy will be returned to you with your request and the requested information, or confirmation that your request has been processed. Failure to provide such documentation will prevent the processing of your request, as it will not guarantee sufficient verification of the identity of the rights holder.

After validating the Basket, the Customer must validate acceptance of these General Terms and Conditions of Sale, identify themselves if they already have a personal account on the Site or create one if they wish.
After validating the shopping cart, the Customer provides their billing and delivery details, also indicating whether these details are different or the same.
Article 8 - Order
The Customer confirms their order by clicking the "Place Order" link at the bottom of the "Summary" page. Before this confirmation, the Customer is always given the opportunity to check each item in their order; they can thus correct any errors and have the ability to identify and correct any mistakes made when entering their data at any time.
The customer must verify all the information provided in this order form, and in particular all the details necessary for delivery (delivery address, access code, telephone numbers, etc.) of their order. The address details must not exceed 32 characters or they may be truncated. Le Petit Florilège cannot be held responsible if delivery cannot be completed due to exceeding the maximum number of characters in the address details.
Orders cannot be cancelled or modified once confirmed and paid for.
In accordance with the legislation, it is impossible to change the billing address after payment and therefore automatic creation of the resulting invoice.
The order placed by the Customer is only effective upon completion of full payment of the sums due.
If, due to force majeure (strike, natural disaster, cessation of activity, death, illness, accident, war, etc.), Le Petit Florilège is unable to fulfill an order for Products made to measure or according to the Client's specific requirements, a full refund of the sums previously paid for this order will be issued and the Client will not be able to take any legal action to compensate for any damages incurred.
Article 9 - Payment Terms
Orders are payable by credit card only.
In the case of an order from a zone other than the zone defined by these General Terms and Conditions of Sale, a payment method by bank transfer may be offered to the Customer by Le Petit Florilège.
When registering the order, the Customer must pay for the entire order using the payment methods offered by the Site at the time of the order.
The Site offers the customer an online payment with its banking partner Crédit Agricole via the secure e-Transactions payment module and via the Paybox system.
This system is only compatible with bank cards certified by 3D Secure, Verified by Visa or SecureCode Mastercard.
If the Customer makes the payment with a bank card registered with 3D Secure or Verified by Visa or SecureCode Mastercard, they will be asked to identify themselves with a personal code guaranteeing their identity to finalize the online payment.
If authentication fails, the order will not be processed.
In order to prevent any credit card fraud, Le Petit Florilège reserves the right to refuse any sale where the payment does not offer all the 3D Secure security validations or presents suspicions of fraud.
After payment is made through the secure server provided on the Site, an acknowledgement of receipt is displayed. This confirms the order registration and informs the Customer that a confirmation email containing all the order details will be sent to them as soon as possible.
The data recorded by Le Petit Florilège constitutes proof of the nature, content, and date of the order. This data is archived by Le Petit Florilège in accordance with legal requirements and timeframes; the Customer may access this archive by contacting Customer Service.
Article 10 - Late Payment
In the event of total non-payment for goods delivered on the day of receipt, the Client must pay Le Petit Florilège a late payment penalty equal to one and a half times the legal interest rate.
The applicable legal interest rate is that in effect on the day the goods are delivered.
This penalty is calculated on the pre-tax amount of the sum remaining due, and runs from the due date of the price without any prior formal notice being required.
In accordance with articles 441-6 of the Commercial Code and D. 441-5 of the Commercial Code, any delay in payment automatically entails, in addition to late payment penalties, an obligation for the debtor to pay a fixed compensation of €40 for recovery costs.
Additional compensation may be claimed, upon presentation of supporting documents, when the recovery costs incurred exceed the amount of the fixed compensation.
Article 11 - Delivery
Product delivery will be carried out at home by the services of La Poste, DPD, GLS, Geodis or any other carrier of the seller's choice, depending on the type and volume of the order, the most appropriate for deliveries in metropolitan France and in the European common market, continental area only.
For delivery to a different zone than those listed on the Delivery page, shipping and delivery will be handled by a La Poste partner or one of the carriers chosen by the seller, within the country concerned, and delivery times may be longer. For delivery to a zone not listed on the Delivery page, a written request must be submitted by email using the contact form provided to the Customer. Le Petit Florilège reserves the right to accept or refuse delivery to a different zone.
Delivery methods vary depending on the type and weight of the package, or at the seller's discretion.
Once shipped to the customer's home, if the customer chooses to have their delivery redirected to a collection point via the carrier's platform, they are informed that the chosen collection point may refuse to accept the package (particularly in the event of capacity limitations, changes in opening hours, exceptional closure, etc.). In such cases, the package will be redirected to a new collection point or a post office located along the carrier's route. Le Petit Florilège cannot be held responsible for this change of delivery location, and the customer cannot claim compensation for any inconvenience caused by a change of collection point from the one initially selected after shipment to their home.
It is the customer's responsibility to refuse any package showing signs of damage or whose packaging has been damaged during transport, immediately upon delivery by the delivery service. Acceptance of a damaged package by the customer is considered acceptance of the goods as is, and Le Petit Florilège cannot be held liable for any damage caused to the goods by our shipping carrier.
A parcel tracking number will be sent by email to the Customer for Colissimo items as soon as their order is shipped.
Delivery times are generally set, for an address in mainland France, to the day of payment validation + 8. This period may be extended in the event of public holidays during this period or if the shop is closed for holidays (an announcement visible on the homepage will inform the customer of the new order processing methods and the extension of delivery times).
Delivery times for Products made to order or according to the Customer's specific requirements are set at a maximum of 30 days.
In the case of an order mixing new products and custom-made or made-to-order products, the shipment may be made in several packages and the delivery times will be specific to each type of product.
Le Petit Florilège will be able to inform the customer directly by email as soon as details of the delivery time are available.
If the Customer provides incomplete or inaccurate delivery information, Le Petit Florilège cannot be held responsible for any delays or inability to deliver. If goods are returned for these reasons, the return shipping costs will be borne by the Customer.
In the case of delivery via Colissimo with signature confirmation, if the customer is not present when the delivery person arrives, a delivery notice will be left in their mailbox or sent by SMS or email. The customer will then have a timeframe, which can be viewed on the carrier's website, to collect the package from their local post office or a partner retailer. After this period, the package will be returned to Le Petit Florilège, and the customer will be responsible for the cost of reshipping.
The Customer is informed that it is their responsibility to check the condition of the package upon receipt , in the presence of the delivery driver, and to immediately report any damage, anomalies, or delivery delays to the driver by noting them on the delivery slip. Failure to note any issues will preclude the Customer from making a claim against Le Petit Florilège. Deliveries by carrier are made to the customer's doorstep on public property.
Should any damage occur during transport, we urge you to contact us within 3 days ( Article L.133-3 of the French Commercial Code ) and provide us with photographs of the damaged package, the damaged product, and the shipping label affixed to the box. After this period, no claims will be accepted, and the products will be considered as having been delivered in good condition.
Article 12 - Right of Withdrawal
In accordance with current legislation, the Customer has a period of 14 (fourteen) working days from the date of receipt of his goods to withdraw and a period of 14 (fourteen) days from his withdrawal to return his package, without justification or penalty.
The right of withdrawal does not apply to personalized products, products made to measure or on request, unsealed products (in particular hygiene products) and fragile products.
The right of withdrawal between professionals can only apply when the following three conditions are met:
- the contract is concluded off-premises
- the subject of the contract does not fall within the company's main activity
- the client company employs no more than five employees
Otherwise, the right of withdrawal does not apply.
For any return under this right of withdrawal, the following procedure must be fully respected:
The Customer will contact Le Petit Florilège via the contact form provided, indicating their wish to return the product and providing the order number given on their order confirmation. To help us improve our offerings, the Customer will have the option to state the reason for the return.
- Le Petit Florilège, after validation of the return, will provide the Customer with the return procedure.
- The returned product must be packaged in suitable packaging that guarantees its integrity during return shipping. - Returns to collection points are not accepted. Parcels must be shipped directly to the return address provided.
- Unless otherwise stated, return shipping costs are the sole responsibility of the Customer.
- Cash on delivery returns are not accepted.
Subject to the conditions outlined above, Le Petit Florilège will refund the total amount, including all taxes, of the order corresponding to the returned products, excluding initial delivery charges if the return is partial. The customer's bank account will be credited with this amount within 14 (fourteen) days of Le Petit Florilège's receipt of the returned products.
In the event of damage, loss, or destruction of the package during a return, the entire order and return costs will remain the responsibility of the Customer.
Article 13 - Legal guarantee of conformity
Le Petit Florilège is committed to delivering Products that meet the current requirements relating to the safety and health of persons in accordance with French provisions, and in particular the legislation on regulated chemical substances.
The Site offers products from handcrafted production (textile items, ceramics, etc.), which may result in variations in color, shape, finish and discoloration, which cannot be considered defects.
The Site also offers used, second-hand, so-called "vintage" Products, which may not conform to the standards in force at the time of purchase; the Customer declares to be informed and to accept them as such.
Article 14 - Customer Relations - After-Sales Service

Article 15 - Satisfaction guaranteed or your money back
In accordance with legal provisions, the Customer has 14 calendar days from the date of delivery to return their order, with return shipping costs borne by the Customer. They will then be fully refunded if the entire order is returned within 30 days of Le Petit Florilège receiving it in good condition. In the case of a partial return, only the amount of the returned product will be refunded. At Le Petit Florilège's discretion, the Customer may also choose an alternative refund method.
Used, incomplete, damaged or soiled returned Products will not be accepted and will not be eligible for a refund, with the initial shipping and return costs remaining the responsibility of the Customer.
It is also the customer's responsibility to keep the original product packaging in good condition for returns. Otherwise, Le Petit Florilège reserves the right to partially refund returned products that are not in a satisfactory condition for resale.
Custom-made, personalized products are not covered by these return conditions and cannot be refunded.
In accordance with legal provisions, the right of withdrawal cannot be exercised for Products made to order, used "vintage" or second-hand products or according to the particular specifications of the Customer.
Article 16 - Sponsorship
The referral program offered by SARL Le Petit Florilège is designed to allow our existing customers (the referrers) to recommend our company to third parties (the referred customers) who have never placed an order with us. Each referrer and referred customer who meets the program's requirements will be eligible for the benefits specified in the current referral offer.
Any attempt to misuse the program, including but not limited to self-referral, the use of multiple accounts belonging to the same person or members of the same household, or any other form of fraud, is strictly prohibited. Referred accounts must be separate individuals and reside at a different address than the referrer.
We reserve the right to refuse or cancel any reward resulting from improper use, as well as to suspend or close the accounts concerned.
This program is a tool designed exclusively for acquiring new customers. Participation implies acceptance of these terms and conditions, as well as the rules of proper use defined by Le Petit Florilège SARL. We reserve the right to modify or suspend the program at any time without prior notice.
Article 17 – Disputes
The Site and all sites of Le Petit Florilège, whose main domain name is lepetitflorilege.com (blog.lepetitflorilege.com, , …) are governed by French law.
In the event of a dispute, the Client agrees to seek an amicable solution before taking any legal action. If all attempts at an amicable solution fail, any legal action may only be brought before the French courts.
Article 18 - Discounts for professionals
We offer a 10% discount on orders of €350 or more (including VAT), for professionals in the space planning industry.
This discount applies only to eligible products, the list of which is at the discretion of Le Petit Florilège. Products considered bulky are systematically excluded from this professional discount.
In accordance with the legislation, the right of withdrawal does not apply to sales between professionals (see conditions in Article 12).
To benefit from the discount granted to professionals, they will have to prove their activity by sending their Kbis extract as a professional in the development sector.
A discount code, to be used by the professional themselves and not their clients, will be assigned and linked to their account. This code and the account cannot be transferred to the client.
Unless otherwise stated, the discount reserved for professionals cannot be combined with sales, private sales, or temporary promotions. If, for technical reasons, an order placed using the professional discount code contains discounted or sale items in addition to the professional discount, SARL Le Petit Florilège reserves the right to cancel the order and offer a new order with the sole discount conditions, at the customer's choice, either at the current promotional price or at the professional discount rate.
